Ancillary Probate
Ancillary Probate
Being licensed to practice in Alaska and Colorado, Mr. Williams can handle probate matters in both states. Sometimes, an out-of-state decedent will have real property in Alaska or Colorado. In order to sell or transfer the realty, an ancillary probate proceeding may be required to transfer the property. This is known as an “Ancillary Probate.” The Ancillary Probate process is relatively straightforward in both Alaska and Colorado. It requires certain documents from the Court where the decedent resided. We can ensure that the Ancillary Probate proceeding is done properly, including the preparation of a Personal Representative’s Deed.
The ancillary process first requires obtaining certified, authenticated, or exemplified copies of the appropriate estate documents from the probate proceeding in the state where the primary (or domiciliary) probate proceeding was commenced. Those documents are filed with our Court here, and the Court will issue documents to allow the Personal Representative to act in our state. This includes selling or transferring real property.
Our office can efficiently handle your ancillary probate matter, and may complete the services at our hourly rate or a flat rate, depending on the circumstances. Please call our office for help in administering estate property located in Alaska or Colorado.
